Ten of Spades: Constitutional Amendment

Give the cell a way to revise its own constitution in the open, at a distance from any live question, and prospectively only, so the structure can be remade by its members without being remade by whoever happens to hold it at the moment.


Overview

A constitution that cannot be amended will be worked around. Practice drifts, the text stands, and within a few years the cell is governed by something nobody wrote and nobody can point to — which is the failure the metric office at the third rung was built to catch and the same failure at larger scale. A constitution that can be amended easily is not a constitution at all; it is a record of current preferences, and it offers no protection to anyone whose position is currently unpopular.

This rung is the office between those two. It fixes how the structure remakes itself: openly, at a distance from whatever question prompted it, prospectively, and within a core the cell placed beyond its own reach at founding. It is the last rung of the suit because a body that can revise its own constitution safely has to have every other office already standing, and because the thing it protects against is not disagreement but the quiet, sensible, well-argued coup.

This is also where the grade reaches its mature form and the constitution records it. What is kept from the older material is amendment as a standing procedure rather than a founding privilege. What is removed is amendment by whoever leads, by acclamation, or by practice. This technic is graded by its own standard like any other.

How it works

Distance is the whole instrument, and it is temporal rather than personal. An amendment is published in full, with what it changes and why, and it cannot be decided until a stated interval has passed — an interval fixed in advance and never shortened for a particular proposal, because every proposal that wants shortening wants it for the same reason. Anyone whose grade, standing, or work is currently in question stands out of the decision on any clause bearing on it. Nobody amends the rule they are currently living under the wrong end of, in either direction.

Amendments are prospective without exception. A revision takes effect from a stated date, binds no decision already in flight, reaches nothing backwards, and cannot validate what was done under the old text or invalidate it. Retroactive amendment is how a body punishes people for conduct that was permitted, and there is no version of it this manual allows.

An amendment cannot enlarge what may be decided bindingly. That scope was fixed by the constitution before any live question existed, and a process that may widen its own jurisdiction will eventually hold all of it — stated at the fifth rung as a caution and made a floor here, because the amendment power is precisely the tool that widening would use.

The unamendable core is named by the cell at founding and cannot be enlarged or shrunk by ordinary amendment. Beneath whatever the cell placed there sit floors that were never the cell’s to grant: the four capacities no body gates, the freedom to leave without penalty, a grade expressing demonstrated competence and conduct alone, the rule of distance, no dossiers or records kept on persons, and the self-application clause. A cell cannot amend these because they do not belong to it, and an amendment purporting to reach them is void rather than defeated.

Exit is what makes amendment legitimate rather than imposed. A member who does not accept a revision may leave without penalty, carrying their grade, their résumé, and their own records, and binding no one who has gone. A constitution that can be changed under people who cannot leave is a different instrument entirely, and the freedom to leave is the reason this one can be changed at all.

Amendment by practice is barred, carried up from the third rung without change. Whatever the constitution is being read to mean but does not say is either written into the text through this procedure or dropped. Precedent does not amend anything here.

And the grade’s mature form is recorded rather than declared. As the corner-holders came into existence — an academy authoring, a guild examining, a registry keeping, the economy pricing — the cell’s own authorship of its metric receded, and the constitution is amended to say so for each craft as it happens. Where a corner has no holder, the cell says which corner is empty and what stands in for it in the meantime, in the manner the guild was given. The fifth corner, the appeal of a lowered grade, has no holder in this manual: appeals sit with lot-drawn members of another cell, and the Court that would eventually hold it is sealed, named here and not built.

Operation

  1. Publish the proposed amendment in full, with what it changes, what it replaces, and why.

  2. Wait the stated interval before deciding, and never shorten it for a particular proposal.

  3. Stand out anyone whose grade, standing, or work is in question on a clause bearing on it.

  4. Decide in the manner of the deciding-together office, within the scope the constitution already fixed.

  5. Make every amendment prospective: effective from a stated date, binding nothing in flight, reaching nothing backwards.

  6. Refuse any amendment that enlarges what may be decided bindingly, or that reaches the core the cell placed beyond itself or the floors that were never the cell’s to grant.

  7. Amend in text or not at all. Anything the constitution is being read to mean but does not say is written in or dropped.

  8. Keep exit free and unpenalised through every revision, with the grade, the résumé, and the member’s own records travelling with them.

  9. Record the grade’s corners as they fill — who authors, who examines, who keeps, who prices — and name every corner still empty, publishing the amended text with what was proposed and declined.

Cautions & failure modes

The interval waived once. An urgent proposal, a general agreement that waiting is silly, and the interval is thereafter a convention rather than a rule. It is the only thing standing between amendment and reaction, and it is worth nothing if it can be set aside when it matters.

The amendment that widens the scope. It arrives as tidying: the deciding office plainly ought to be able to settle this sort of thing too. Each widening is small, each is reasonable, and the destination is a body that decides everything.

The core quietly redefined. Not amended — reinterpreted, so that a floor is read as applying more narrowly than it did. The text stands untouched and the protection is gone.

The retroactive fix. Something was done under the old text that everyone now regrets, and an amendment could settle it cleanly. That is punishment for permitted conduct, and it is the most tempting single amendment a cell will ever consider.

Amendment by exhaustion. A proposal defeated and returned, defeated and returned, until the people opposing it stop attending. Nothing improper occurs at any stage, and the constitution changes because one side was more persistent.

The constitution that keeps improving. This is the failure that arrives from running the technic well. A cell that amends skilfully amends often, and a text revised every season stops being a constraint anyone plans against — it becomes a live document expressing what the cell currently thinks, which is exactly what a constitution exists not to be. The floors will not fall to a coup. They will erode through a hundred sound revisions, each of which improved the document.

Prerequisites

  • A constitution signed under the Ace of Spades naming its own unamendable core, and a deciding-together office under the Five of Spades to carry the decision.
  • A stated interval between a proposed amendment being published and being decided, fixed in advance and never shortened for a particular proposal.
  • Grading standing as an office distinct from directing under the Seven of Spades, so that nobody amends the rules of a grade they are about to give or receive.
